00:05:33
Yes.
George Goodwin
Member, Planning Commission
00:05:35
Very well, the Minister approved.
00:05:37
Next item is consent agenda.
00:05:38
We do not have a consent agenda this month, so we'll move directly to public address.
00:05:43
Public address is a period of time when the public can come forward and address the Planning Commission on any item that is not a public hearing tonight.
00:05:55
So if there's something that is not a public hearing tonight that you'd like to speak on, now would be the time to do it.
00:06:01
I'm going to open the public address period.
00:06:04
Publicly addressed period is open.
00:06:06
Each person will have three minutes to speak.
00:06:08
If you represent an organization, please let me know.
00:06:11
I don't have any cards, so I'll just call whoever's first up.
00:06:15
Come forward, please, and speak.
00:06:17
Please state your name and your voting district.
SPEAKER_05
00:06:20
It's Dale Turner, and the voting district is Louisa.
00:06:26
And we've, my wife and I, Mary Ellen's, we've lived here
00:06:32
I want to thank you all for being sitting in that seat where you are.
00:06:48
Let every soul be subject to the governing authorities, for there is no authority except from God, and the authorities that exist are appointed by God.
00:06:59
So I figure that you all are sitting in that seat by divine appointment.
00:07:04
And yeah, believe it or not, Tommy, but the decisions you make come from individuals who are appointed by God.
00:07:14
So it's no accident that you all are sitting there this afternoon.
00:07:18
So the thing I'd like to discuss, we met with a several of you with the preconditional
00:07:31
John Disosway, James Dickerson, John J. Purcell IV
00:07:41
He had sent you all an email with several of the items on that he wanted to discuss tonight, but he couldn't be here.
00:07:50
And I reckon the thing that I'm concerned about and that we're concerned about in his email is that we've all been to a football game.
00:08:02
And we've all heard the proverbial move in the goal post.
00:08:07
And I want to tell you a story.
00:08:10
And this actually happened.
00:08:12
The year was 1970.
00:08:15
And it was the Turkey Bowl in Roanoke, Virginia.
00:08:21
And I was sitting on the VPI side, and Mr. Goodman was sitting on the VMI side.
00:08:29
And he was sharp, I tell you.
00:08:33
He was decked out in his cadet uniform.
00:08:36
I mean, everybody could see him.
00:08:38
And I was sitting over with a VPI crowd.
00:08:42
But anyway.
00:08:44
The score came down.
00:08:46
The VPI was, I think, two points behind toward the end of the game.
George Goodwin
Member, Planning Commission
00:08:52
Three seconds left, and VPI brings their field goal kicker out on the field goal.
SPEAKER_05
00:09:00
I mean, it was a chip shot.
00:09:02
You couldn't have missed.
00:09:04
So he lines up, kicks it, and you wouldn't believe what would happen.
00:09:10
And this is a true story.
00:09:13
Here, Mr. Goodman runs out on the field, moves the goal post while the ball is in the air, and the VPI guy misses it.
00:09:24
And then Mr. Goodman runs back, gets in the crowd, and as the cadets who were going back to Lexington, they took our cannon and dumped it in the James River.
00:09:39
And I think it was you that took the cannon.
00:09:43
But anyway, the idea of this is the moving goalpost.
00:09:49
And that's what Joshua's email was part about was that you have back in 2013, you already have what you have.
00:10:02
It was recorded back then.
00:10:05
And the person who's got it, the conditional use permit,
George Goodwin
Member, Planning Commission
00:10:13
Your time's up.
00:10:14
Can I use Mary Ellen's time?
00:10:19
Ms. Turner, would you like to come forward and speak?
00:10:26
All right.
00:10:28
Then that's fine.
00:10:30
We'll reset it for three minutes.
00:10:32
OK.
00:10:32
But you have three minutes.
SPEAKER_05
00:10:34
But yeah, it's a true story.
00:10:36
I wanted to make sure everybody knew that.
00:10:40
But anyway, and that's what we're concerned about, about the campground permission.
00:10:47
You can read Joshua's email.
00:10:49
The second thing, I've got a friend, he's a truck driver, he says when we're going too fast, he says we need to tap the brakes a little bit.
00:11:00
And this is what I'm concerned about with the 15 acre minimum and lining up with what it looks like in Pennsylvania.
George Goodwin
Member, Planning Commission
00:11:10
I'm concerned about that and let me make no qualms about it.
SPEAKER_05
00:11:16
I'm against the power line people against Valley Link as much as anybody else here, but I'm a realist.
00:11:25
The people that we're going against, these are trillion dollar companies.
00:11:29
And there's probably five or six of them.
00:11:32
And you can imagine fighting against trillion dollar companies.
00:11:36
So I'm a realist.
00:11:39
And I know that when those people come knocking on your door and
00:11:46
It would be an insult to the people in Louisa County for them to say, I'm going to give you $10,000 for your land, $15,000.
00:11:54
It would be an insult.
00:11:56
These people, and that's one thing that I disagree with them on besides the power line, they say they're going to send the real estate people out.
George Goodwin
Member, Planning Commission
00:12:06
Well, they're not real estate people.
SPEAKER_05
00:12:08
They're negotiators.
00:12:10
and I guarantee you they're looking right now.
00:12:14
They've got their AI program.
00:12:17
I'm sure their program have got Dale Turner.
00:12:20
And yeah, we've got a dog in this fight out on Bib store road about 14 acres.
00:12:31
So that being said, we need to be careful because they're looking
00:12:38
They're looking at the weakest point and if we take our land, it's zone A2
00:12:45
and they're going to look at that and say, okay, we're going to destroy seven lots of the turners, but if it was zone A1, we're going to only destroy three lots of the turners.
00:12:59
So, you know, if you place more restrictions, if you place more restrictions on it, when these negotiators come to the citizens of Louisa County,
00:13:09
They're going to use that against them.
00:13:11
And you know, it all comes back to the to the dollar sign.
00:13:15
And it's, it's not, you know, I'm just concerned that if you make it harder to
00:13:22
to subdivide your land, especially with what's going on now, that I would probably wait until we see what's going to happen with the power line.
00:13:33
Hopefully, there won't be no power line.
00:13:36
That's my hope.
00:13:37
But anyway, my time is up.
00:13:39
And my hat's off to Mr. Goodwin.
00:13:41
I'll give him a salute to Mr. Goodwin.
00:13:43
But yeah, that was a true story where he ran out on the field and moved to Gold Post.
00:13:49
Thank you all.
00:13:49
And you're all doing a good job.
George Goodwin
Member, Planning Commission
00:13:52
Thank you, sir.
SPEAKER_05
00:13:53
And that's why my wife, we've been married 55 years.
00:13:57
Thank you all.
George Goodwin
Member, Planning Commission
00:13:58
Thank you.
00:14:00
And now we know something else about planning commissioners.
00:14:06
Would anyone else like to...
SPEAKER_04
00:14:07
I could have stood up and swore that was the truth.
George Goodwin
Member, Planning Commission
00:14:11
Would anyone else like to address the planning commission during the public address period?
SPEAKER_02
00:14:19
Here we have a phone call coming in for the planning committee.
George Goodwin
Member, Planning Commission
00:14:24
Before I close the public address period, we did have one email come in with a request to be read, so I will do that.
00:14:34
It's a short email, and since it's short, it's from a Mike Wilson.
00:14:40
Mike Wilson addressed this to Tom Eglin.
00:14:43
and said we are traveling so we are unable to attend the meeting tonight.
00:14:47
Could you please read this letter on our behalf?
00:14:49
Thank you in advance.
00:14:50
It is our understanding that decisions have been made and additional decisions may still be under consideration regarding the definition of a campground.
00:14:58
Unfortunately, we are traveling out of town and are unable to attend this evening's meeting.
00:15:02
However, we will remain informed about any actions or decisions resulting from tonight's discussion.
00:15:08
We would also appreciate clarification as to whether any distinctions have been established or being considered between the use of RVs for workforce housing and the operation of a recreational campground.
00:15:21
Understanding how these uses may be defined and regulated differently would be very helpful.
00:15:26
Thank you for your time.
00:15:27
So that was that request.
00:15:32
There being no other folks wishing to speak,
SPEAKER_02
00:15:36
I wanted to just frame up, there was an email that was sent to the community commission that staff was copying on this afternoon from Joshua
George Goodwin
Member, Planning Commission
00:15:45
Yes and this is this is a good bit longer generally don't read long emails it was that was a short one but this one did go to all the planning commissioners and this is being entered into the record for the meeting so we have this and it was unclear whether we had the other one because of the address so yeah but thank you
00:16:07
Very well.
00:16:08
Then I'm going to close public address period.
00:16:10
Public address period is closed and we'll move on.
00:16:15
Next is unfinished business.
00:16:19
We had reports during the work session on the work that's ongoing for ordinance changes for slowing residential growth and for campground.
00:16:34
Those are the two items that the
00:16:38
Commission has as work items right now.
00:16:41
So we've already heard those and discussed them.
00:16:46
So I'm not aware of any other unfamiliar, sorry, unfinished business.
00:16:52
So in that case, we'll move on to public hearings.
00:16:56
First public hearing up tonight is Agan Forest District for Goldmine Creek, Ms. Breakville.
SPEAKER_01
00:17:05
Good evening, Chairman and members of the Planning Commission.
00:17:08
I will go through these.
00:17:10
So tonight we start with the Goldmine Creek Ag Forest Still District.
00:17:14
So I will say all three were recommended for approval by Ag Forest Still Rural Preservation Committee.
00:17:19
So I just wanted to say that in case I forget later.
00:17:21
In this application, there's landowners Matthew Craig and Jason and Anna Anderson.
00:17:25
There's four parcels totaling 284 acres.
00:17:29
The proposed addition consists of three sets of parcels.
00:17:31
The first is located 1.36 miles from a qualifying portion of the Goldmine Creek Agriculture and Forest District north of Hiding Place Road south of Route 620 and west of Route 629 in the Louisa voting district.
00:17:44
The second parcel joins a qualifying portion of the Goldmine Creek Agriculture and Forestry District and is located east of Route 669, south of Route 613, and west of Route 628 in the Mineral Voting District.
00:17:56
The final set of parcels joins a qualifying portion of the Goldmine Creek Agricultural and Forestry District and are located along Route 613, south-southeast of Route 628.
00:18:05
and West of Route 687 in the Mineral Voting District.
00:18:08
The Louisa Comprehensive Plan designates this area as rural and the subject parcels are used for crop hay, timber, vegetables and livestock including goats, pigs, chickens and rabbits.
00:18:19
All landowners are excited to be working toward land preservation in Louisa County so I can stand for questions at this time.
George Goodwin
Member, Planning Commission
00:18:26
Are there any questions for staff at this time?
00:18:31
Very good.
00:18:33
Thank you.
00:18:33
So I'm going to open the public hearing on this.
00:18:36
The public hearing is open.
00:18:38
The first speaker generally for the public hearings is the applicant.
00:18:42
Is the applicant here tonight?
00:18:45
Very well.
00:18:47
Then we'll move on.
00:18:49
Would anyone like to speak on this application tonight?
00:18:57
Very well, seeing none, I'm going to close the public hearing period.
00:19:01
Public hearing is closed, and we'll come back to the commissioners for comments.
00:19:10
Questions or comments?
00:19:17
Mr. Hicks.
SPEAKER_00
00:19:19
Ms. Bergville, this applicant and
00:19:25
And believe me, we greatly support any effort they're making in joining an AFD and all that they're doing.
00:19:30
But did they incline to what was potentially their primary reason for joining an AFD and doing what they're doing?
SPEAKER_01
00:19:37
So all of these applicants were for just basically in preservation.
00:19:41
They have been interested for months prior to Valley Link.
00:19:45
We had been having discussions with them and they were just able to get their applications and so I will say we're kind of backlogged three plus months depending on the month you turn in your application.
00:19:55
So like just because you were seeing it now in June they had submitted it months prior.
SPEAKER_00
00:20:00
And just just curious because we got a lot of these every month now and that is truly something to celebrate and be absolutely proud of and just on an individual basis wondering
00:20:10
if they had if this was Valley Link related or imminent domain or preservation.
SPEAKER_01
00:20:15
I had been working with each of these landowners prior to Valley Link coming in so I guess now I mean we can't really determine that answer for every application because Valley Link is is here and has been here but I was working with them prior.
George Goodwin
Member, Planning Commission
00:20:32
Okay thank you.
00:20:33
Any other questions?
00:20:36
Mr.
00:20:37
Chair.
SPEAKER_04
00:20:37
Mr. Goodwin.
00:20:38
Clarification.
00:20:39
Are we now considering all three of these?
00:20:43
No.
00:20:44
Ms. Breakfield keeps saying all of these applicants and...
SPEAKER_01
00:20:48
So there's two sets of applicants on the Goldmine Creek application.
00:20:53
Matthew Craig and then Jason and Anna Anderson.
00:20:56
So when I say applicants I say collectively.
SPEAKER_04
00:20:58
Okay so we are just looking at number one.
George Goodwin
Member, Planning Commission
00:21:01
This is item one.
00:21:03
Okay.
00:21:03
Just want to be clear.
00:21:06
Very well.
00:21:08
Seeing as how no more questions, Commissioner Kersey and I share this one, but I believe I have a two-thirds share, so I'm going to turn the gavel over to the Vice Chairman for this.
00:21:25
And I'd like to make a motion to recommend approval to the Board of Supervisors for this addition to the Gold Mine Creek Ag and Forest Hill District.
SPEAKER_03
00:21:34
Fantastic.
00:21:35
We have a motion.
00:21:35
Mr. Kersey, do we have a second?
00:21:37
Second.
00:21:38
Thank you.
00:21:39
Any discussion?
00:21:40
Hearing no discussion, Ms. Johnson, a roll call vote.
SPEAKER_06
00:21:46
Mr. Hicks.
00:21:48
Yes.
00:21:49
Mr. Painting.
00:21:50
Yes.
00:21:51
Mr. Disosway.
SPEAKER_06
00:21:54
Yes.
00:21:54
Mr. Dickerson.
00:21:55
Yes.
00:21:55
Mr. Quarles.
SPEAKER_03
00:21:55
Mr. Goodwin.
00:21:55
Yes.
00:21:57
Mr. Kersey.
00:21:57
Yes.
00:22:00
Motion carries.
00:22:02
Turning the gavel back over.
George Goodwin
Member, Planning Commission
00:22:03
Thank you, sir.
00:22:04
The next up is an amendment to the Ellisville Ag and Forest District.
SPEAKER_01
00:22:10
Yes, thank you.
00:22:11
So again, this is the Ellisville Ag and Forestal District.
00:22:13
There is one landowner on this application.
00:22:15
His name is Rene Gutierrez.
00:22:17
There's two parcels totaling 57.97 acres.
00:22:20
The proposed district addition adjoins the existing Ellisville Ag Forestal District.
00:22:25
The parcels are located east of Route 628 and west of Route 625 in the Mineral Voting District.
00:22:32
The comprehensive plan does designate this area as rural and the uses of the land are timber.
00:22:38
And I will say for I guess motive, Mr. Gutierrez did not know about Ag Forrester districts recently became educated about the districts themselves and decided to join the district once learning about what the program was and what the long-term benefits are.

00:23:24

00:23:32
Very well, so this one also is in the Mineral District.
00:23:35
We'll turn the gavel over.
00:23:38

00:24:31
Three parcels showing 85.098 acres.
00:24:35
The proposed district addition adjoins an existing qualifying portion of the Green Springs Ag.
00:24:39
Forest District.
00:24:40
The parcels are located east of Route 613, west of Route 649, and north of Route 637 in the Patrick Henry Voting District.
00:24:48
The parcels are considered rural in the comprehensive plan.
00:24:52
Uses are timber, pasture, and sheep production.
00:24:54
And again, back to to purpose.
00:24:57
This landowner and I began meeting in February and they were just able to get into kind of the stack of applications.
00:25:04
But they are very excited to work toward rural preservation in Louisa County and have been interested in this program for a long time.
George Goodwin

Next item up is new business.
00:26:36
We don't have any new business business.
00:26:40
Very good.
00:26:40
And I'm not aware of any discussion items we have right now, which will take us to report.
SPEAKER_05
00:26:48
So if you would please give us a report for the July meeting.
SPEAKER_02
00:26:54
Thank you Chairman Disosway.
00:26:57
As you see listed on your agenda coming up for next month there are three public hearings for agricultural and forest districts.
00:27:06
Two of those are for additions.
00:27:07
One is for a brand new district.
00:27:10
There is a public hearing for a rezoning request.
00:27:14
From commercial to agricultural in order for the owner to complete a family subdivision of the property The land was purchased and they did not realize that they couldn't do a family subdivision and so they are asking to rezone the property to complete that family subdivision and
00:27:35
I believe you have at your seat a copy of my notice for a variance application that's going to the Board of Zoning Appeals next week by state code we are required to notify the Planning Commission of variance applications just to make you aware of it you're welcome to speak it come to the Board of Zoning Appeals meeting to speak if you have any questions or concerns about that application it is for
00:28:04
They received a variance and then during the construction process it's a very oddly shaped lot, a lot of flood zone on it.
00:28:13
There's unusual right-of-way along Route 601 at Painesville Road in that location and during the construction process the topography and everything
00:28:26
and some issues with their contractor it ended up three feet closer than the original variance that they were granted so they are asking for an additional three feet.
00:28:37
At the May 18th Board of Supervisors meeting the board approved the comp plan amendment for electric transmission facilities and the conditional use permit public hearing for that same topic will be at the July 6th board meeting.
00:28:53
The only other thing staff has is that we do need to get with each of you about your tablets that were issued by the county.
00:29:02
Mr. Quarles found out in trying to get his working that they're all outdated and if they need to be upgraded they're not able to be upgraded so I just need to we need to communicate with each one of you individually to see if you want the tablet because we're gonna have to look at purchasing new ones.
00:29:22
And that's all I have.
George Goodwin
Member, Planning Commission
00:29:25
Very good.
00:29:25
Any questions for Ms. Buckley?
00:29:30
All right.
00:29:30

Second.
00:29:39
We are adjourned.
