I'd like to call tonight's Planning Commissioner meeting to order.

Thank you all for being here.

I'd like to start by welcoming two new Planning Commissioners, Mr. Smith and Mr. Mitchell.

Sure.

Well, I'm actually new, right?

I'm Hunter Smith.

I've been in resident here for nine years and operate a few businesses here in town and I'm excited to be here.

And I'm Hosea and good to be back.

Welcome and thank you.

And we thought we would fill the agenda for you this evening so that you could feel right at home.

Thank you.

I've attended two committee meetings over the last month since we met last.

The housing advisory committee met on May 16th.

In that meeting, the highlights include the allocations committee which reported on work with the city staff to revise the Charlottesville area affordable housing fund application process.

and in doing three things in particular a lot first aligning with the city's housing policy one objectives secondly allowing applications to be made multiple times during the year and see change the membership of the review committee to include public housing and low-income residents

and then secondly the Housing Advisory Committee reviewed recommendations to City Council on the proposed land bank ordinance in particular they're recommending to create a governing board that better represents the low-income housing community to increase terms from officers from one to two years to partner with CRHA and all affordable housing development projects

and in disposing of property the land bank should first offer it to local affordable housing non-profits for affordable housing and finally obtain first right of refusal for any land to be disposed of by the city.

The second meeting I attended, Tree Commission, on June 5th.

The current urban forestry management plan was completed in 2009 and will need updating soon.

The Parks and Rec staff would like to explore a broader scope city plan for land and natural resource management.

This would be a more inclusive plan and would include other city departments such as Health, Parks and Rec, NDS, Public Works, and Utilities.

and this idea is endorsed by the tree commission.

Secondly, the tree planting committee has targeted Belmont for public education on the benefits of planting trees.

The commission members and Charlottesville area tree

Stuarts canvassed the neighborhood on June 2nd with educational material.

Many residents expressed interest and the commission will follow up with the hope of eventually providing trees and planting assistance.

And then lastly, the tree commission members expressed their concern over the recent loss of many large aged trees in our city cemeteries.

We discussed the significant challenges with planting in the cemeteries, especially the older historic cemeteries.

Several commission members will investigate Maplewood Cemetery and look for the possibilities for tree planting.

I like the idea of planting trees in Belmont where I grew up and had many happy memories of tying a jump rope to one side of a tree and impeding the sidewalk.

Well, they're missing those two that you're

Jump Rope is attached to Belmont.

And a lot of loss in those decades since I lived there.

10 points for soldiering on there.

This last month, the place task force did not meet, nor did its subcommittee on community engagement.

I did attend a meeting of the Board of Zoning Appeals, and there were kind of two cases that were, I think, interesting and might be relevant to what we do here.

Often they aren't.

They're so unique to a particular situation.

One was dealing with environmental impacts on a non-conforming lot and we do have some of those in the city and so to the extent that we can provide guidance since they are in a way a buy right development if there are ways to mitigate environmental impacts that's good and maybe something that could be addressed in the comp plan just to provide a little bit of

environmental guidance there.

The other one was about setbacks in a new area and I thought again as we talk about ZTA's and comprehensive rezoning we might want to look at our setback requirements relevant to those few unique new areas that are new streets that are developed in the city because sometimes that just doesn't seem to work.

So I just wanted to point those out.

I also attended the Planning District Commission meeting which was held in conjunction with its annual retreat and annual meeting and at that meeting we elected Supervisor Rick Randolph from Albemarle County to succeed me as chair because I'll be going off after

after August.

And in our strategic planning session, we dealt primarily with a survey that had been sent out to those who have contact with the PDC, elected officials, planning commissioners in the region, administrators in the region, and others.

That report will come out for the commission in August or September to be approved.

And I think you will expect to see a continued emphasis on housing.

in terms of planning and addressing it but not in terms of providing or managing housing and perhaps there was a desire expressed for more planning guidance in the environmental and preservation areas.

And welcome to the new commissioners.

I want to welcome in particular Hosea back as a veteran.

I remember you calling me a neophyte when I joined, when we served together before.

And that was great because it really motivated me to learn enough to not be a neophyte.

And I think it's terrific to have you come back with your two or three years experience to be a veteran here.

So welcome and welcome to Hunter as well.

And for our new commissioners who have yet to be appointed to a subcommittee, that will come soon.

So have no fear of this.

No wretch.

We will rectify that shortly.

So I think the biggest news is that within the last few weeks, Brandon Avenue was transferred from the city to the university.

And we're very appreciative of all the effort that went into making that happening.

So the Green Street project is moving forward and is well under construction now.

Otherwise, our board of visitors met last week.

And they had a schematic design review for a renovation of Walderman Library.

That project will have a significant effect on University Avenue as you go east up toward the university by creating a new and very welcoming elevation on that side of the building and actually adding an entrance on the north side of the building.

So I think it will have a substantial improving effect on people's experience of coming up that big hill.

The Student Health and Wellness Center that I mentioned last month on Brandon had a design review

and the new softball stadium at the corner of Massey and Copley Roads had a design review and those were well received.

And finally, there was a discussion about a new athletics master plan.

So I had no subcommittee report, but I did want to report on a couple things.

We do have many vacancies since we have had the departure of Mr. Tantoski and Mr. Keyseeker.

And so I am looking at the new committee assignments and checking in with you guys probably this week and early next week so we can get those assignments made so you can start

On your way to more meetings.

Right now we do have the vacancy at the vice chair.

Since we are very close to our annual meeting, which is in September, we will be, I will be appointing, no.

My brain just started working.

You can't point.

No, not a point.

Designating two members for the nominating committee in August

so that they can nominate the new chair and vice chair for our annual meeting in September.

Maybe that's ended for this tonight and I can keep moving.

So, look forward to that in August.

And then, in my absence, Miss Keller will be, as the most senior member and the past chair, will take over, but I don't have any planned absences, so I think I'll be here, barring I don't get hit by a truck on the way out, and you guys can work that out.

Then our next comp plan next steps.

We have a work session on June 26th.

At this time it is here but that may change due to a wide variety of interest in that meeting so we can have a larger place to meet.

We will be reviewing the data received from the May meetings to begin reviewing the data received from the May meetings.

So if you guys make sure you bring your calendars to that June 26th meeting because I have a feeling that we are going to schedule additional work sessions to review that data and discuss next steps.

We are making a lot of progress on getting the data from our March and May meetings into a format that can be reviewed.

We're lucky at this point of time.

We have a summer intern who we've been able to provide direction.

and get that compiled.

So our plan is to have portions of that to you next week which would be a week in advance of the work session and post it online and then other portions of that to you at the meeting on the 26th.

So stay tuned.

We do have that moving forward.

So with that data, we are gathering the chapter champions again on the staff side to get the draft chapters for every chapter except for land use into a new draft form so that you all can review those.

And that will allow you all additional time to focus on the land use aspects as well as the land use map.

But you'll still have access to all of the data that has come from that.

So we have a process that we've started where once we have that data ready, we're going to provide that to the champions.

We're meeting with them and then giving a time period.

So that we will have by mid-August new drafts of the other chapters for you all's consideration.

So that'll be going on simultaneously as you all are working through land use aspects so that it can come back to you all.

in another form.

So we've got that.

And then just wanted to update that the Cherry Avenue Small Area Plan process is underway.

There have been a number of focus groups and porch meetings that are in the process of occurring.

Sure, the planning district, Thomas Jefferson Planning District website has updates on that and they're providing data on different focus group meetings that are occurring and they're working towards some larger community activities in the Cherry Avenue area as well.

So they do have a specific portion of the website.

One quick thing.

19th, which is Tuesday evening.

I had set up to go and answer some questions about the comprehensive plan if anyone wanted to talk about that.

I would welcome any of you who want to go with me on the 19th.

I still think I'm scheduled to do that.

I neglected to mention in my PDC report some of Missy's comments reminded me that

On the TJPDC website is a small blurb about the new opportunity zones and I had requested that as more information becomes available we take those into account in our future land use planning for the city because there are areas in the city that have been designated for that but the guidelines for those programs really aren't out yet and there are also areas in the county and wherever they're contiguous it would seem

to make sense for us to follow those guidelines and to address it where we could knowing that there will be these new programs that might have an impact in those neighborhoods which are primarily in the southern part of the city.

At some point it might be worth waiting until we know more about what it means.

Right now we've got a map.

One note about that.

The Zero Carlton Project, which will be coming later this evening, we've already had our public hearing for that item for the special use permit at our March 2018 meeting.

So there won't be another public hearing for that.

Tonight we're listening about the critical slope waiver and we decided not to decide yet on the special use permit until we heard more about the critical slope waiver.

So if you'd like to speak to zero Carlton, now's the time to do that as well.

So at this time I will open the matters to be presented by the public, not on the formal agenda.

And first on the list is Kate Muir.

Did I mess up?

Thank you commissioners.

I would like to speak to the future Riverbend development that is coming in Belmont.

They have submitted a buy-write application, and we were told that by the developer, we were told that that is actually a placeholder.

They wanted to get that in before potential zoning in Belmont had changed.

So they also said they're going to be submitting for an SUPs and for increased density.

There was conversation about swapping a piece of land at the Belmont Lofts with a piece that Mr. Capshaw owned at this other part of Rivanna Trail, which would increase the acreage and then be able to increase density.

So I think what I'm going to do is speak to the buy right, because that's the only thing we really have to work for from right now.

And that's 138 residential apartments, and the traffic engineer said that with the formula that they plug in for that number of residents.

There would be 450 residents driving out and 450 residents driving back just to locate where this will be.

It's across from Moss, Jimmy Detter's old property, the Five Acres, Kohl's, a mechanic shop.

So it's a really narrow street.

It's quite an interesting intersection with all the restaurants.

So if you can just imagine a thousand more cars right there in downtown Belmont.

That would be pretty horrific.

And with this SUP, what they're looking to do is increase the density so that there would be actually more traffic.

So BCNA, our neighborhood association, has been working on this since last year.

And we're just really asking for a thoughtful process as far as infrastructure.

This is incredibly complicated.

This is engineering.

This is environmental.

It's up on a slope.

Mr. Detter had lots of cars and trucks.

I've even done land reclamation, reformation, working with the streams back there.

And so one of our problems is how do we follow the threat of accountability and how long is that process?

Without a city manager or someone to really oversee these projects at this point, this is a huge project.

It's a huge suburban

type development right downtown in Belmont.

My friend and neighbor will address the NCC and different zoning, but what we're really looking for is kind of laying out of what's our process, what's protocol, what's the procedure.

Riverbed has come to our meetings and said they're anxious to have a dialogue with us and then we found out that there was a plan submitted and so we're going to go back and we really want to have more dialogues and we want to understand how can we really engage with a developer to have a really smart, sharp,

I'm Kathleen's friend and neighbor that she mentioned earlier.

My name is Eugene Scatini and I live on Douglas Avenue.

Starting off with

Written words are very powerful.

They are a collection of these words that form the basis of our zoning code.

Words are necessary to convey civic duty and responsibilities in executing community visions and these words are binding.

They are written and they are part of the code.

So therefore, I am here to understand how these words can be enforced as clear language and clear expectations.

At issue is a comment made by some MDS staff members early in the week, which was reported in the Daily Progress.

about the Belmont apartment development, specifically how one reviewer's comment who quoted verbatim the language of the neighborhood commercial corridor within the review comments and which was considered a recommendation, really.

So is the entire zoning code a recommendation?

I feel the objectives and the intent are clearly communicated in the listings of the requirements of the mixed use corridor districts.

And the neighborhood commercial corridor district is a unique animal that was developed many years ago.

And I was part of that development and spent many hours drawing circles on maps and stuff with Karen Freehoff and Ron Higgins.

and it's unique to Belmont and Fry Springs and I think it's very clear the purposes are laid out very clearly is to encourage mixed use development and then the objectives are laid out very succinctly encourage a use of mixed development, demonstrate appropriateness use of scale, development offered creative minimization of impact of parking facilities and traffic,

Landscape spaces available for pedestrian uses, alternative forms of transportation, I guess they mean explore alternative forms of transportation.

15 years ago I think we were thinking cover boards, but those haven't come yet.

Neighborhood and economic activity, home ownership, and importantly neighborhood participation in the development process.

The objectives further states that each of these zoning districts are going to encourage a mixture of residential, commercial, and cultural uses within a single building or within multiple buildings and structures.

And particularly important is creation is a vital center for economic growth.

So when we developed these plans, the neighborhood commercial corridor was an extension of downtown Belmont.

which would encourage the use of a vibrant community since it would outgrow the confines of the existing into the new one.

Good evening Planning Commission.

I'm wanting to share some concerns from CLIC in regards to the comprehensive plan process that we're currently going through.

What I want to talk about first off is the well-scripted comprehensive plan community engagement sessions.

Truly authentic open input

was truly not

I would say upper middle income and upper income folks who are primarily white, certainly not representative of the folks that are going to be affected by any changes in the comprehensive plan that could result in some zoning changes.

Also, your comprehensive plan must have a housing strategy that centers on a cohort of our city residents that struggle daily

with extremely low incomes within our 10 square miles, i.e.

according to the HUD's 2018 income guidelines would be 30% of your area median income, which currently for a family of four is $25,600.

It doesn't get you much in the way of housing.

So also the city has to acknowledge that there have been decades of racist housing policy in this city.

And if our comprehensive plan does not contain a strong housing strategy,

that centers on our extremely low income neighbors and the racial inequities of those prior zoning strategies that were used in this city, then you must not proceed with that comprehensive plan until those questions are addressed, acknowledged and worked out.

CLIC has requested that movement forward on the comprehensive plan be delayed until there is a strong housing policy

or at least it is solid enough to be incorporated into your comprehensive plan.

There is also it looks like zero time for public input on your housing needs assessment study because it looks like the deadline for the comments and the release date of that study are simultaneous.

The public needs time to consider, you know, the study.

to look at how the data was collected and any questions about data collection.

And also with such new members, don't you all want time to consider everything as well?

Also as part of the housing strategy, my own consideration is that there has to be a strong anti-displacement policy within that strategy because until we get enough units online that are sustainable because the word affordable has been corrupted, kind of like the word organic,

I don't really use it.

Until housing is sustainable, we need to keep people in their housing.

First, I'd just like to remind everybody, please make sure when you speak that your microphone is pulled towards you.

Otherwise, when you're at home and listening, you can't hear what's going on.

And if you're hard of hearing, like I am, have some hearing loss, you can't even hear back here in the back.

To the new members of this board, I'd like to say welcome.

I'd like to primarily direct my remarks to you.

You have an important nonpaying job that is vital to the city.

I've been following this board's decisions for many years.

I would like to ask that you become knowledgeable on the properties that you may be making decisions on.

Don't go only by the information package that staff gives you.

Go out to the properties and look around.

Don't believe everything the applicants tell you.

I've seen many times how this board has been misled and sometimes outright lied to

on matters.

Be aware that some people may want to present a sunny side.

A little skepticism is not a bad trait.

Development can be a good thing, but should be in keeping with the character of the neighbors and not overpowering.

One hundred years from now, we should be proud of the projects that you may approve.

It was recommended to me late this afternoon that maybe I should tell you a little story if I had time.

It looks like I do have the time concerning the coal tower project.

which really stands out in my mind.

And I was at the city council meeting when the developer came before the council to talk about that project.

One of the council members asked what the price range of this project was going to be for the individual homes.

And it was basically a situation where the council was very concerned at that time about affordable housing.

and basically the developer said, well, it's going to be about $250,000.

Well, I knew that a three-story townhouse with elevators was going to be a lot more than $250,000.

At a later date, I was at a staff meeting and before I had a chance to ask the developer the question, someone else asked the question what the price was going to be and he said that $250,000 was for the land.

So that's an example of how council is misled about this situation.

Those houses, by the way, now are selling for low-priced ones or $1.2 million.

Hello, my name is Karen Katz and I'm going to be speaking for my husband and I who live at 1012 B. Jewett Avenue in Belmont.

And the reason that we're here is because we are among a few recipients of a notice from a third party consulting firm that does seismic surveys.

requesting that we call and schedule an appointment for a seismic survey to be done at our home because the people who are building Belmont Point are finding that they are encountering impenetrable rock.

And so they want a blast.

And they're anticipating what is very likely to occur, which is that every home within

at least 700 feet of this area and not only are there homes but there are two ball fields at Quarry Park that's owned by the city and there is within a foul ball of that park there is the Rivanna Trail.

and so they want to blast, their request is that residents call to schedule this survey so that they can determine pre-existing conditions.

Well clearly that is so that later on when you go to sell your house and you find that there's a crack in your foundation or in your plaster, in your drywall, in your window,

in the window seal that they can say, well, geez, too bad.

That was a preexisting condition.

And anyway, by the time most of the damage would be evident, Southern Development Homes will be long gone and they'll be their insurance companies who specialize in the two-letter word no.

and there is no compensation that you can give to somebody whose home is damaged by this kind of ridiculous.

It's ridiculous.

It's outrageous that we are expected to assume some of the financial and health lifestyle risk.

so that Southern Development can build 23 homes.

Now I've been getting a lot of calls.

This letter was left unscientifically haphazardly on our door and it was not addressed to anyone.

They didn't even bother to find out who are these people who they are engaging in this

Salacious Partnership.

And so I've spoken with people who are contractors and they tell me that blessing, there is no good outcome to blessing.

And so we're asking for you to please become involved in this.

Hello, my name is Kimber Hocky.

I live at 709 Belmont Avenue and I'm speaking for myself, my husband, and a number of Belmont residents who have sent me their concerns.

I've basically listed it and I'll just start reading comments that people have sent me regarding the upcoming Riverbend project.

And as you can tell, a lot of us in this area feel under assault from what's going on.

So, first of all, as far as the character of the neighborhood, the Neighborhood Development Services has guiding principles that do not seem to be in harmony or be sustainable for the neighborhood.

The Riverbend development is out of character for the neighborhood, architecturally and in size.

It would be overwhelming for the neighborhood for those reasons.

Currently, the by right development doesn't take our community into account.

It's inappropriate for the site and the neighborhood.

It's non-conforming and doesn't fit the neighborhood.

We need to preserve the character of the neighborhood and the city should value this more.

We recently have been designated a historic district.

Developers certainly do not care as they only want to maximize their profits.

There will be noise, ground and air pollution that will be horrible for residents who will suffer for years without compensation.

The quality of life around the project will be permanently damaged.

Construction will take over sidewalks and cause unsafe pedestrian conditions.

There is an unsustainable footprint and people are concerned about the waterways and marshlands that are in that area as well.

As far as traffic and congestion goes, the neighborhood has already been suffering for the past 10 years at least under the strain from new restaurants, the pavilion, other recent ex-park events where you have conflicting, you can hear noise from either end.

We already fall victim to an influx of restaurant goers.

If you figure there's five restaurants there or 100 people average a night, that's 500 people coming into your neighborhood.

Restaurants like the local La Taza and the Junction have started bringing in busloads of students who don't respect the neighborhood, yelling, partying in the streets and using people's yards as bathrooms.

The infrastructure will not support all of this, especially considering all the other projects coming down the pipeline it seems.

And so people believe that this will be unlivable due to the traffic and the increased pollution.

There's all the added cars per day.

that was already talked about, but you have to think about all the other cars that will be added to our area from all the other constructions as well, such as the Tarleton Oak Circus Station.

The local school has also stated that they are concerned about an influx of students and that they cannot take in many more students into the Belmont neighborhood.

There are environmental concerns.

There are lack of environmental safeguards.

There was loss of trees and woods, which we were just talking about with trees.

That's kind of ironic.

The loss of wildlife and bird habitat.

There's no green buffer.

Landscape is destroyed.

And finally, we want to ask that the SUP is being asked for two of them for increased density and increased height.

They'd be denied, and that the land swap be denied as well.

Good evening, ladies and gentlemen, Brian, David, not that you're not included with the gentleman part.

My name is James Kelly.

I'm a resident of Charlottesville, a resident of Belmont, a resident within the 500-foot zone that we're currently talking about with the southern development blasting radius that they've given us notice of, short notice.

I did not get, I live within that zone, but I did not get the notice that everyone indicated that had been given.

but that aside for just a moment.

I'm a licensed general contractor, Class A licensed general contractor in the state of Virginia.

I've been in business for more than 40 years.

Before joining UVA and working with David and Jody at UVA, I worked in Northern Virginia, built everything from small entry-level homes to multi-million dollar construction projects.

I'm not unfamiliar at all

with blasting and the effects of blasting on buildings and homes especially close to the blasting radius.

500 foot is a pipe dream.

Blasting radius extends well beyond 500 feet depending on the condition of the subsoil and the rock that may be found in the blasting area.

Hard rock will penetrate and will travel a whole lot further than 500 feet.

It'll travel as much as 1,000 feet, and the results of blasting may not necessarily be found within the first week, two weeks, a year.

It could be as far as five years out that cracks occur because of weakened soil, weakened stone.

It could also affect not only foundations.

Let's talk about foundations for just a second, quickly.

The houses in Belmont were primarily built in the 30s, 40s, early 50s.

They were not built out of concrete block foundations.

They were built out of cinder block foundations, which is a whole different world.

than concrete block foundations.

Concrete block foundations are much more solid.

Concrete is much more solid than the cinder block that most of those homes were built out of.

Cinder block is very fragile, especially block that's 60 years old, 70 years old.

It'll crack in a heartbeat.

It'll splinter.

It'll deteriorate over time.

Cinder block is a whole different consideration than other foundations.

in addition to of course plaster lathe walls that are in homes in Belmont to a large extent and even old drywall so the effects will not be known immediately it'll be known over a long much longer period of time and there is no resolution for it it'll happen and there's nothing you can do about it but more importantly Belmont is riddled with subsurface sewer systems which are built out of the old terracotta clay

You may be able to photograph foundations for homes.

You may be able to document some existing cracks.

You may be able to see immediate cracks in homes, but in subsurface foundations.

That's one thing, but when you start getting underground to old terracotta pipe, which Belmont has got a plethora of, you will not see it until it is too late.

Terracotta pipe is extremely fragile.

It breaks in a minute.

and you've already spent a tremendous amount of money or Charlottesville's already spent a tremendous amount of money repairing terracotta pipe that is disintegrated in Belmont already.

Blasting will disintegrate the rest of it.

Anything within five, six, seven hundred feet, maybe five, seven, eight hundred feet and you won't know until it's way too late.

Some elaboration and I believe some other commissioners had questions, but I don't want to pull it from the consent agenda.

I agree with that.

I had some comments.

I don't want to pull this either, but there seems to be some contradictions.

and I'd like for staff to take a look at this and since this is an initiation of the zoning text amendment, I would like for staff to at least research three other localities to see how other localities are doing this.

I mean we're not reinventing a wheel here or we should not be.

There are other urban areas that are having construction going on and need construction lay down areas.

I don't have...

I would suggest urban areas that are already doing this.

I can give you a specific example.

I mean there are definitely urban builders around and you can see as you drive through town non-urban builders.

We're building urban so we need to look at how urban design should be.

We had a hotel come to us and say we build urban.

and they're barely taking any of the street.

And then we have other things on West Main that did not say we build urban, maybe they're suburban builders and you can barely cross.

So I would suggest you look at how other urban builders do this and go with some standard practice.

But I think so often we get information without backup and I'd just like to see us take a look at other localities.

That's my soapbox, sorry.

I would just ask about the housing study that was put on the council agenda for June 18th.

That is not coming before the planning commission.

The second thing is right now there is no deadline for the comprehensive plan.

We're just trying to put together work sessions and get information based on,

pull the data together based off of the meetings we've had so far and definitely we have new members that need to be caught up.

But your assessment, even if it's going to council, doesn't provide for any time for community input before, you know, it's cut off.

And we don't normally do this, but I thought there were some very significant points brought up this evening.

and we don't have a place on our agenda to address those so I wonder if we could in the future have someone from staff follow up.

I think these issues about the blasting in Belmont are really serious but I don't see anything within our purview.

I think it's great that they

made us aware of it, but I don't see any way that the Planning Commission can address that, so I don't want people to stay here all night and think that we might be able to address it.

And the second thing I wanted to clarify is that the needs assessment study is not the planning commission study.

It is the HACS study.

We have a representative to the HAC.

We have staff that might be able to address that in the future.

But it's not our study.

We weren't involved in it.

We weren't even aware it was starting.

And now we've been told we need to hold things up until it's done.

And now we're being criticized for it.

And it's not our study.

So I hear you.

And I too was thinking that we need some staff follow up.

We had some very important things come up tonight.

And I know we have at least had one commissioner here, our council member, for that whole thing.

But if we are going to add that housing study in our comprehensive plan, I'd at least like to see it.

So if we could get that sent to us, that'd be great.

and we aren't, I'm not sure how we can help with the blasting.

I'm not happy about it either.

I'm a Belmont resident, but I'm not sure how we can help.

But maybe Missy can report back and give us some information on what is going on and what can be done and if council needs to have a report on this blasting.

And then also, I hear you.

I'm getting a lot of calls on Belmont Ave.

I don't know, I haven't seen anything, but I think it's something that will be coming before us at some point.

The information that we had at the meeting in early April and the comments letter that went out on August 9th.

Sorry, April 9th is the most recent correspondence that we have on that project.

So tonight's first public hearing, SP18-0002, 946 Grady Avenue, Dairy Central.

Landowner Dairy Holdings LLC, by its agent, has submitted an application seeking approval of a special use permit, SUP, to allow for a mixed-use development that will contain multiple buildings, some mixed-use buildings, some single-use buildings.

The purpose of the SUP, Special Use Permit, is to authorize residential density up to 60 dwelling units per acre per city code section 34-780B within the entire mixed use development site and to authorize an increase

and the maximum permitted building height from 50 feet to 65 feet per city code section 34-7772.

The subject property is identified on city real property tax map 31 parcel 60, tax map parcel ID number 310060000.

and has an area of approximately 4.35 acres.

The subject property has frontage on Grady Avenue, Preston Avenue, 10th Street Northwest and West Street.

The subject property is zoned Central City Corridor.

contains an individually protected historic property and is situated within the entrance corridor overlay zoning district.

If a residential density of 60 dwelling units is granted, that will allow a total of 261 dwelling units within the development site.

Under the current zoning, only 187 dwelling units could be developed at a 43,

Madam chair commissioners and members of council this is a special use permit as the chair described it this previously came before you in your capacity as the entrance corridor review board in March so it should look somewhat familiar in that you've seen it once before so

The special use permit is for the Dairy Central property as highlighted in the materials presented to you.

It is about 4.3 acres located on Preston Avenue and Grady Avenue with frontage also on West Street and 10th Street.

The proposal to break down the phases of this, because there are several phases included in this plan and that's kind of a point of confusion.

The existing Monticello Dairy building, which is a designated historic property, has been designated by the applicant as phase one.

That has a final site plan that is proceeding through review now.

They do propose a partial demolition on the back there of some of the newer additions to that site and an office component to be built on the rear there.

They obviously have to preserve the frontage because of the historic designation.

The applicant is before you tonight to discuss phase two and phase three, although we do want you to consider the whole project in its entirety.

The phase two is the area immediately behind the Monticello-Dare building on 10th and West, which is currently a parking lot.

That area is shown in your materials.

They also are including phase three, which is across the old Wood Street right-of-way, which is when you do enter this site and park off of Preston, if you take that right turn, you're going on to what used to be a right-of-way, an old city right-of-way that's been closed, but it used to be a street designated as Wood Street, and it does run

Pretty much the length of the site.

So that is a dividing line between phases one and two and phases three, which is back on West Street, and phase four, which is the rest of the Preston Avenue frontage.

The applicant is designated phase four to be a structured parking facility with commercial development, no residential development planned for phase four.

So that phasing breakdown is in your materials tonight.

As a special use permit, you have a standard of review shown in section 34-157 of the code that addresses, tells you to look at several features, several matters when evaluating the proposed impacts of the additional height and density.

The applicant is requesting one is the masking and scale of the project, which you have discussed, you partially hinted, talked about in March.

Traffic and parking congestion on adjacent streets.

When staff looks at this, obviously there's a big concern about the impact on 10th Street, particularly heading towards the university and towards Main Street.

The traffic engineer has already been in discussions with the applicant about what type of physical improvements can be done around the edges here to force movement

If it does go on to 10th Street, force movement towards Preston, towards the major arterial that this project sits on where the traffic can be handled best and not going through the 10th and Page neighborhood.

So our traffic engineer has looked at that.

The project does, even at a buy-write level, does produce a significant amount of traffic, a number of trips leaving this site.

Noise, lights, dust, odor and vibration, which this project really is similar to the surrounding properties on Preston Avenue.

Displacement of existing residents or businesses.

There obviously is no existing residential on the site.

The existing businesses, there have been some displacements there, but they're actually replacing far more interior space once they're done.

The ability of community facilities in the area to handle additional residential density and commercial traffic.

So one of the interesting discussions that the applicant has had that I was present with was with the Superintendent of Schools and a member of the public touched on this.

A different project, but they did mention that what we did learn in that meeting from the school office is that when a large apartment complex, which typically in planning terms you're not worried about school kids and apartment complexes, families with kids, typically it's a very small impact to the schools in terms of new children in that development.

But what the schools did relay to us was apartment complexes that have been built within the city, they have seen a spike in school enrollment.

And it's not from people moving into the apartment complexes.

It's from people that are currently living in the city in low density residential areas that would prefer to live in an apartment.

When those apartments open up, they're moving into those and families are backfilling into the low density residential district.

So they have seen a big spike in

spikes in enrollment when apartment complexes have opened up, particularly on West Main Street.

So this will have some impact on the schools.

They obviously have met with the superintendent.

They've given the breakdown of what they consider the people that would be residing in this.

So the schools are aware of this project and where it's coming and the facilities that will be impacted by it.

Impact positive or negative on availability of affordable housing.

Obviously, no housing is being removed.

The project does propose 20 units that meet our definition of affordable housing.

I'm sure the applicant would like to talk more about that.

I do want to clarify one note in the staff report.

Fifteen of those units are in phase two.

The remaining five are in phase three.

I think I might have said all 20 were in phase two.

That's not true.

So overall, staff has done a review on this.

We do find that the impacts associated with the increased density and height of the request can be accommodated by the site.

We recommend it be approved subject to the conditions that we put in the staff report.

One note that I did send to you earlier last week that I want to clarify.

Condition number two mentions the original materials that we were presented in January 23rd.

You want to change that date to May 22nd to reflect the most recent.

materials that you've been given.

Additionally, I know some members of the public have suggested some conditions and we've commented on whether we think those would be enforceable or appropriate to include.

I know you discussed some of those in your pre-meeting and we'd certainly welcome any changes to that and that discussion.

for New Commissioners, those recommended conditions are page 8 of our staff report.

Yeah, are we able to talk a little bit about the parking?

It looks like it's going to have to be staged, and maybe the applicant will need to address some of it.

Yeah, so I'll comment on the zoning regulations and how we do a phased development and then the applicant can certainly talk about the specifics on the site.

When we look at a phased development, and I think what the applicant is pursuing here is kind of an overall plan of development and final site plans for each phase as they come in.

So at the conclusion of Phase 1, the site has to be adequately parked.

At the conclusion of Phase 2, it has to be adequately parked.

If the presumption throughout the project is if at any point the project ceases, we can't backload the parking in the final phase.

So that's a review that happens with every single phase of this as it comes forward.

Where's your parking?

If there's temporary displacement, what are you doing about that?

Are you securing temporary parking leases on adjacent properties to offset that?

And then where is it permanently?

So they have some options in terms of offsite that they could potentially explore.

But like I said, there's no, yeah, we'll do the parking in the final phase.

Don't worry about it.

And then they never do it.

I would refer that to them.

Certainly that would come up, typically comes up as a site plan comes forward.

So certainly phase one doesn't have any problems with parking because the phases three and four become a surface parking lot to support that use.

As we receive those final site plans, they could get a special use permit and conceivably if they can't make that parking thing work, they'll never get a site plan approval for

Lyle had some questions that he sent to you in an email and I've seen those, but I doubt that everyone has seen those.

You could read them off to me.

I might pull them up here.

Yes.

And we've spoken to the traffic engineer about that.

We've already had conversations internally as staff about that.

It's not enough to – I think we've been debating.

You know, is it a no left turn sign or is there an actual physical, what we usually call a pork chop there that makes the movement, the turning movement very difficult to get over a curb, do it so people are funneled.

So we've looked at that.

A lot of that depends on the traffic study that the applicant's going to have to do for this project.

It generates enough trips for that.

But a chief concern of the traffic engineer is

limiting the amount of traffic going back through the 10th and Page neighborhood so that's yeah we've looked at that we've looked at it there's a point of access on Garrett on Grady that's kind of an interesting intersection because of these the slip lane there so I know the applicants also mentioned potential improvements eventually you know helping with the city with a I think we're actually doing a smart scale application for the Grady 10th intersection because of just how

Could that be a condition of the NSUP?

I believe so.

I'm guessing we can't condition an SUP on perpetual neighborhood meeting access.

I would leave the final word of that to our legal counsel on that.

I have several concerns about that.

One is the enforceability from staff's perspective.

If we find out it's not happening, how do we go in and enforce that and make that happen?

Yeah, there were several concerns I had about it.

Enforceability is a big one.

Can we actively enforce that?

That's an item that typically is handled through, would potentially be handled through like a community benefit agreement in the event.

Correct.

That's an issue.

Yeah.

And I think in the back of my mind, I was kind of saying, oh, I know what I was talking

The conditions need to address an impact of the special use permit.

So is the additional height and residential density creating the need for this community room to be open to the community?

That, I think, you know, if the applicant is willing to submit to that and says, yeah, sure, we're willing to commit to that and we're happy to have that as a condition, that's fine.

Right.

Right.

Your residential density and additional height is all in Phase 2 and 3.

So this is a tip, you know, outside the bounds of the special use permit.

So once again, I think I would, if the applicant is fine with making that commitment, that's fine.

You know, if it's the make or break on a special use permit, I think I would look at it.

If it can't be guaranteed, you know, I'd kind of look at that as that's an amenity that's coming in Phase 1.

I had a final question.

So, the affordable housing 34-12 of the city code requires affordable housing for special use permits and rezonings beyond a certain size.

So, it is a zoning requirement.

They have to do a certain amount.

They've been in contact with our housing planner, Stacy Pethia, about that.

discussing how that happens.

So it's not something that really needs to be in a condition because they've got to do it no matter what once they're in this area.

I know the applicant has mentioned going above and beyond the requirement.

How that gets memorialized is

I think something I would refer to my attorney on that one.

But whether we can do it or not, I know I think Stacy weighed in on that.

To piggyback on that, there's nothing in the code to say what kind of affordable, so everything could be 80% AMI.

So what I normally say is that, for example, if you have an application that says, I propose to give you

Development that'll include 10 affordable dwelling units and they'll be affordable at this amount of AMI.

It's okay to be very specific in crafting your special use permit.

So we approve a special use permit for the proposed development in this application that is proposing, you know, to include 10 units.

If they're not being that specific, if they're just saying we are proposing this development, we plan to include affordable units in accordance with your ordinance, we may exceed the requirements, you can't impose that additional requirement on them.

But if they have offered to you, if the development plans that are in front of you say, we propose this specific development and here's what

What we are proposing to include, your special use permit can be approved for that specific development.

Yes.

Stacey met with them and I think it was 80 percent, 10 units, 60 percent, 5 units, and 40 percent, 5 units.

Well you should ask the applicant whether that's what they're proposing.

Any other questions for staff?

I had a couple real quick.

Okay, I have a question about some of the conclusions that were led.

One, specific items from the comprehensive plan that support the proposal are as follows.

Under land use, you had, when considering changes to land use regulations, respect nearby residential areas.

And then over as a specific item, do not support the same thing.

I think it depends on your, you know, the amount of respect that you're giving to that and the amount of deference you're giving to the adjacency to a low density residential neighborhood.

You know, the minimum height, the maximum height across West Street in many, in some portions is 35 feet.

I do believe the applicant has done a step back of that, but it might be, you know, you feel that, you know, there were some concerns I know raised about.

just the nature of a building like this adjacent to the low density residential area.

So I do think that the applicant has taken some measures including the conditions that are proposed for the step backs, you know, trying to put the bulk of that building as the additional height in the middle of the site, but there's also that question of

you know is this in your mind too much use next to you know the additional residential density and height does that create too much of an impact this could be a means to if you had seen that and edited this which one would you have taken that out of sorry in my in my mind the I think I would have taken it out of the second one I think it's you know

When we have a minimum height of 35 feet, you have a street wall of 45, that's a transition.

Preston's a major corridor.

I think they've taken pains to do that.

Second thing on economic sustainability, you pulled that one out for the comprehensive plan.

Have you been given a breakdown on how many jobs created and types of jobs since that's

This supports our comprehensive plan.

And the encouraging of...

I'm lost.

So that's the old commercial corridor study from... Tortigallis.

Tortigallis.

Yeah.

So that was just locating stuff on the corridor.

I think the applicant can speak to the amount of office space that's being generated in phase one of the site.

It is, I think, 50,000.

Okay.

I believe the I would defer that one to the applicant I mean I do believe it's it's a 100% rental

Well, I think the overall goal of that, that's an overall goal for the city.

I hear you and I'm not saying we should ask everyone to do that, but based off of your report, you state that these specific items from the comprehensive plan, this proposal supports these that you pulled out.

And I'm asking you if you have information, so if it doesn't support, accommodate this, I don't think we can use that as one of the things that it achieves on our comprehensive plan.

So that's what I'm asking.

Do you have information?

So if it's all renter, then it's not both renter and owner.

Well, I think the goal is to be applied citywide.

And so if you are lacking rental units in your housing market, this meets that goal because you are promoting more options than you have now.

So that's the way I look at that goal.

This project doesn't have any ownership as a component, right?

It's all intended to be rental, at least at this point in time.

Okay.

And then you had said that this encouraged

Multimodal travel increased cost effectiveness of future service and has Amanda Ponce weighed in on this?

Transit-oriented supported development.

So Amanda has looked at phase one of this project.

It's a primary corridor.

It's within proximity of downtown.

It's in proximity of the university.

It's a convenient location for pedestrians and bikes.

The amenities are existent on Preston Avenue.

They obviously could be improved.

The second thing is, or the next thing is under the attachments are traffic and parking congestion in adjacent streets.

I feel like those are too contradicting and maybe you can help me with that.

Proposed project will impact traffic on streets adjacent to the building, especially 10th.

So we're looking at the difference between the Bi-Rite and the SUP maximums in this situation.

So the residential density allows for an additional number of units on the site.

The impact of this developed under a Bi-Rite scheme will be substantial.

That addition is not something that the staffs opinion of the site can't handle at either level.

So that's probably clear as mud, but.

There's a baseline to it that, you know, you would get no matter what, and then is this increase from the residential density and height such that it would tip it over to the point where it's making an undue impact?

And then I have one last question.

Central city corridor under our reviews for mixed use districts, you have highlighted there the central city corridor, the intent of the central city corridor district is to facilitate continued development and redevelopment of the quality medium scale commercial.

I know we're lacking some definitions in our ordinance, but do we have kind of a definition?

I think that is regulated through the definition.

I think building heights and setbacks regulate what your scales are.

You can't go to 101 feet here.

Yes, one more.

I see a couple of suggested conditions, three and four, both about suggested setbacks, just to move the building back a little bit from the street.

Where did that come from?

In conjunction with a special use permit, you can modify your setbacks and step backs.

So these conditions are to kind of set in stone the building that you are seeing in terms of the regulatory requirements for going up a certain amount of height on the street wall and stepping it back.

Staff had communicated to the applicant that we were particularly concerned about the West Street street wall and the step back and making that a condition of the SUP that that additional height is pushed back, that it doesn't loom over West Street.

So that's what these are intended to do.

The 10th Street one is also, you know, that does have adjacencies to low density residential as well.

So it was really about creating that street wall and trying to

Could you address how much we can rely on the figures on page two?

Under background and details of the proposal, I'm speaking specifically about the number of square feet that are devoted to different uses such as office space and residential and restaurant and brewery.

It would seem unreasonable to think that perhaps a brewery or a restaurant would exist there into perpetuity and that those uses might change, but we've been burned on SUPs and the mix between commercial and residential and so forth, so I'm just trying to

So those uses, the restaurant use and the brewery use are in phase one.

I don't know that the special use permit specifically- Phase two identifies 202,305 square foot mixed-use building, 175 residential, and 1,358 square feet of commercial retail space.

So could we rely on these figures or would we need to memorialize those in conditions?

for the future?

I'm not asking could.

I'm asking we want to rely on this in the future.

Would it be a wise thing for us to put percentages or square footages in the conditions, or will the applicant and successors be held to the figures on page two?

If it's important to you, put it in your motion for approval.

Understanding that this development will be refined as they further develop their concept plans,

through the point where they get site plans and then later construction plans.

It probably is easier to take square footages and translate them into percentages instead of saying 1,302 square feet of something that somebody may later want to be 1,305 square feet or something ridiculous like that.

But if it's important to you to make sure you get characteristics that are

They're being offered to you in this application, then you should call them out.

We will also include a condition that says that the general characteristics of the development will be as referenced within the application.

There's a lot of stuff in applications that's just noise.

that we can't rely on in the future.

Well, the commissioners are settling in.

I'll introduce the team that we have tonight.

My name is Chris Henry.

I'm the president of Stony Point Design Build.

We are the developer of the Dairy Central Project.

I also have Lee Quill with me, who is the president of Cunningham and Quill Architects, the lead designer on the project.

We also have representatives from Timmins Group, Civil Engineers, Water Street Studio for the landscape architecture, and Williams Mullen for land use consulting.

So with that, I'll start.

And so what you saw on the cover sheet was actually the Phase 1 of Dairy Central.

This is a public market and office space.

This is the bulk of the commercial space that we'll be having on the project, and this is going to start construction this August.

We're very excited about that.

As we worked through our public process with Phase 1 and moving into Phase 2, we conducted a pretty extensive community engagement campaign.

We worked with the neighborhood and hosted a series of public community design days actually at the site.

The first one we had about 18 people show up to.

We wanted to really get a lot more feedback about the project than that so we hosted another one at the site that I think some of the planning commissioners were at that was covered in the press and we had about 58 people show up and that was getting a little more like it and through that we actually reached out to the neighborhood to form a project community advisory committee and started a series of monthly meetings where we would go and we would actually talk about project issues.

We would discuss the packages that we were submitting for review.

and then we met with a series of other stakeholders that might have an interest in this project both in the city, the county, we met with the school system, Dr. Atkins as mentioned previously and some neighborhood groups such as Cities Promise, Habitat for Humanity.

Next slide.

What we heard from these community meetings was affordable housing is an acute need both in this neighborhood and Charlottesville in general.

I think that's a point that's not lost on anybody in the room.

And so we really crafted our plan for phase two around how can we help the city achieve some of the goals of producing more affordable housing, specifically onsite in the projects where housing is being created.

and so we've put together a proposal.

I think the affordable housing ordinance that our SUP package triggers requires five units to be created or some equivalent amount paid into an affordable housing fund and we really looked at how can we go beyond that to help achieve this acute need in the community and we're offering to build 20 units on site in our project between phases two and three and that's at 80% area median income.

This is four times the required amount and it's 30% of the additional units that we're requesting here tonight.

That's a big deal and I just want to make that point that this has not been done in a residential development that I know of in the city so far.

And we think that's something that we're really proud of.

It took a lot of work with the community to get there and it's responding to the biggest need that we saw.

You know, we have a series of other community benefits that have been discussed in community meeting space that's sorely needed in that area.

We're working on an application right now for new market tax credits to be able to provide office space for local non-profits at a below market rent.

Obviously, there will be job creation.

There will be hundreds of new employees working in the office space in the public market doing the food stalls and the retail.

There will be property management and maintenance jobs with the housing component.

There will be leasing offices, et cetera.

So hundreds of new jobs will be created on site.

And our contractors have committed to having a job fair.

to try and provide as many of their construction jobs to locals in Charlottesville and 10th and Page neighborhood.

And then moving on, we have a series of public improvements to the pedestrian and streetscape around the project.

And also phase one is targeting a LEED Silver certification.

Phase two would be an Earthcraft multi-family building.

So there's sustainability built into what we do.

We're very proud of the way that we build and we include those in all of our projects.

It's good to be back with you again.

As you know, we were here in March for the preliminary.

So we'll take you through a number of slides.

Some of these you've seen.

This is one that locates a site.

You've seen this.

You've seen this one, which is the aerials of the area.

Again, the phase one, which is in the upper portion, phase two, which we're talking about today, which is this area right here, and phase three, which is adjacent.

Those are the primary visuals that we're talking to right now.

A couple things here, those refinements.

This presentation just kind of clarifies a few things from our discussions at that particular one.

One thing is we have a condition, again, of the step back of 10 foot at the fifth floor.

That is in there.

We also, just to be very clear, instead of going for a potential 30-foot height for an SUP, we're only asking for an additional 15.

and from the property line back on the upper level here, we are now 45 feet back from the property line.

We are also along 10th Street, we are pulling back from the property line 11 foot

down to 9 foot 5 because it tapers along here.

So we are pulling the whole building back, not just the portion up at the top.

We're stepping back here and pulling back here and end up here.

And in order to break down the scale, the transition as a transitional site, we have dealt with the frontage by carving out large courtyards, which we'll talk about next.

So again, on this particular one, it just shows basically what would be by right in yellow and phase three.

If you were to take everything and clump it together, it would be additional.

Here's the aerial from the southwest corner showing how the streetscape has worked, the courtyard.

So it's not a continuous wall along West Street.

Next.

This is the view from the southeast showing the existing parking lots that are right now.

West is right here.

And again, the sculpting out right here.

This is phase one, phase two.

Phase three would step in at this point at some time in the future.

What does it look like along West Street?

This transition that Brian talked about is very, very important.

So it's a little hard to see here, but we have this is where we have

about one of the wings that comes down in a four-foot or four-story height.

Then there's a large cutout of the sculpted-out area here of 40-some feet.

Again, a wing, 40-some feet.

And to get a better feel for what that looks like, this is a rendering that shows that these are substantially large areas that range from 40 to 46 feet, depending on where there's a pullout or a bay, et cetera.

We're going to come back and talk about this area just a little bit more, because since our submission on 22nd, we've been continuing to work with our landscape architect on how to maximize landscaping on this.

Next.

So here on 10th Street, again, you can see the public right-of-way.

We've put in accessible doors to all the units here.

The interesting thing along here is that we have got

a 6 foot clear pathway and it ranges from 9 foot 6 here all the way up to 11 sidewalk here with encroachments like this but we have maintained even though it's a type A street from the streets at work which calls for a 5 or 6 we've maintained 6 and in the next image you can kind of see here it has these little step out areas it also calls for

a five foot from curb to sidewalk continuous strip so that we can maintain areas there for the trees adequately along there.

Next.

In this particular area, you see the southeast corner along West Street going down to Wood.

This is what you saw.

We continue to talk about this area a little bit with our landscape architects.

So next slide.

And we will talk about that more.

In one comment responding to Commissioner Lahendro,

How do you handle the corner?

We've been looking at how this was a six-foot height here, and then now we've actually done a stair, and we've got some more treatments along here that we want to talk to you about further.

Again, as you can see, if you look at the street of the frontage that is actually solid versus from property line to property line,

38% of that area is open, so there is not 100% wall across the street.

Keep in mind, again, that this is a commercial use here.

And there are three houses that sit here.

And there are three houses, one here, one here, and one here in an open lot in this area.

So we've sculpted the building in this transition area to be respectful and sensitive to the houses across the street.

Next.

As you go up, you can see the courtyard's carved out.

And again, that pullback on the upper level right here of being 45 feet back from the property line.

Again, keeping in mind the property line is about six foot from the property line out to the curb line.

And on 10th Street, we actually have another five feet.

So we're dealing with about 14 feet in many areas along here.

That plant strip is about five feet in addition to the six and then the three or four.

Parking is located underneath the building in the center.

It is accessed through the internal alley, not off of West, not off of 10th.

And the elevations are the same.

Again, keeping in mind that we're stepping up to 49 feet here, and then we're asking to go to 65 back into the center of the site with this area right here where we have the additions on top at the fifth floor.

OK. You had asked us last time to come together and show you studies for shadows, again, in the summer.

We are north of West Street and east of 10th, so we have sculpted the building.

So the shadows do not, well, first of all, these are all south, so it won't cover, but we also sculpted the building.

So you can see in the summer, there's really no impact on the adjacent housing.

And when you go to, I just have a couple more slides.

When you go to the next one in the winter, you can see in the early morning at 10, there's a minimal impact here.

But by 11 o'clock, even the houses to the west are not impacted.

And of course, because we're north, minimal impact to none on West Street.

On landscaping, again, we worked with our landscape architect to really get planted areas along here a little more substantial than what we submitted in a 20-second.

So we can literally get continuous runs here so that the root balls have a chance to grow.

We can actually get more planting in here.

This was shown in there.

We have a tree, Ali, along the condition in the alley.

And along here, we've worked with planted walls and planters.

with lower trees such as shrubs and things which Eugene can talk to within a planter with seeded areas here so that we're getting much more of an intimate scale along these areas.

Thank you, and we just wanted to leave you with the project highlights here on the last slide, the affordable housing, the community meeting space, the job creation, education opportunities, and the pedestrian improvements around the site.

Yes, so what we're offering to provide onsite is 20 units at 80% AMI and what you're referring to is a request we've made to the city through their economic development department to partner with them and provide units at a more deeply affordable rate.

That's something that the community was very interested in and we've proposed a tax increment performance agreement

where in exchange for a reduction in the property taxes, which are going to be in the hundreds of thousands of dollars, multiple hundreds of thousands of dollars for this building, we would reduce the rent to 40% for those five units and 60% for an additional 10 units.

The configuration of the portable units, what is it?

The units would be built exactly like all the market rate units in the project and they would, the mix, the whole project is one and two bedrooms and the affordable units would be the same mix as the rest of the project.

So I think we're at like 65% one bedrooms, 35% two bedrooms and the affordable units would be spread the exact same way.

that would be spread throughout the buildings and mixed in.

The intent is that they're not clustered in one area.

Would those be dedicated units?

In other words, if apartment 110 is affordable, will it always be affordable?

I don't know the answer specifically if it's tied to the unit number, but we would have to have that number of units available in the complex.

So I might defer to Stacey for more information on exactly how that's done.

And one thing I didn't mention in the presentation was the duration of the affordability period.

That's my next question.

So these are affordable for 10 years?

I have two items.

First, before being a planning commissioner, I spent a great deal of time working with your team, understanding what you're doing along with my neighbors, and I applaud your work to engage with the neighborhood.

I think that you've set a gold standard for public dissipation that everyone else will be measured against.

Some suggested language here about

10 feet off the 10th Street.

You said 9.5 feet at the smallest point.

The reason it's 9 foot 5 is because we are providing a 6 foot wide clear path.

Streets at work

says a neighborhood A street, we've gone through this extensively, so requires a five or six foot.

We know that there's been a desire for six foot.

So if we went to five, we'd have no problem because we'd moved the building out six inches.

So what we've said is we thought that six based on conversations would be preferred and because we're trying to keep five

on Wood Street plus planted area.

We don't want to squeeze the plants out so we have no plantings.

So we've been working with Eugene and Water Street on what's an acceptable strip along 10th Street, what is an acceptable tight area for shrubs with surface berries and those types of trees and shrubs.

along Wood.

I wanted to clarify that condition because it's actually speaking to the fifth floor of our building being stepped back from the face of building.

Ten feet was the intention of that condition.

So really looking at

Since we're asking for the additional height of the fifth floor, there was a concern that if we didn't add a condition that that additional height might go anywhere on the site.

So we were really looking at that step back for the fifth floor from the face of building on 10th is what the 10-foot reference is and then the 45 feet from West Street.

So just really guaranteeing that you have

significant step backs in particular on West Street but also having the step back on 10th to minimize any visual impact from the pedestrian level and that certainly is not an issue.

We're kind of double doing it.

And also one thing that I think is important to consider for this condition is that there's also four feet of public right-of-way there that's getting improved and so if you add that in where it

So we're around 14 feet of public realm space on the sidewalk.

I want to be clear.

We're being asked for an SUP for phases two and three.

And Phase 2 is articulated wonderfully, lots of information, great information.

Phase 3 at this point in our packet is a conceptual blocking diagram.

So we're obviously, Phase 3 is coming in the future.

So we haven't gotten to the level of design on that building yet to bring that before you.

However, I think we're happy to commit to if you wanted a condition about the quality of materials or the same level of articulation.

We also know that both phase two and phase three will be returning to the entrance corridor

Review Board as part of the design overlay.

So both of those will have to go through the additional design review with this board.

But I think in terms of the special use permit for the additional height that we're requesting, it has the same level of step back for that fifth floor building and the same general setbacks as this other building, and it's also designed by the same

But there are things about phase two that are wonderful, the openness, the connection between the sidewalk and the interior of the buildings, how it embraces the activity on the sidewalk that I just don't have any assurance of that happening at phase three.

And so it just occurred to me that we're being asked for phase three, two, and I don't

And our understanding of the process is that this SUP is really addressing the density and the massing on the site.

And so that's what we have for the Phase 3.

We're happy to have a condition that the materiality and the finish quality and the articulation along the street would be the same as Phase 2.

And like Ashley mentioned, there's another level of actual architectural design review

that still has to be done for this building, so it will come back before you to specifically look at the architecture.

It's between the Planning Commission and BAR for Entrance Corridor, and in this case, the Planning Commission is designated to do that review.

This is really simple.

Parking is a problem in Charlottesville.

Sure.

So phase one is really not a problem.

There's plenty of site available for the surface parking lot where the future phase two and three buildings will sit.

Phase two as we show provides 143 spaces under the building and the additional spaces would be shared in that surface parking lot.

I don't think that phase one and two are going to create a parking problem and as we get to the future phases to build out on that lot, we're going to have to be building parking probably under the phase three building.

We also own the Atlantic Emergency Warehouse site.

which is south across West Street from this project.

And the intention would be to look at that.

It's about half acres.

It's the same size as the footprint of the parking garage.

Nancy Carpenter, and I happen to live across Preston Avenue in the Rose Hill neighborhood.

In a lot of ways been very impressed with the community engagement that this project has enveloped with where I live and then across the street and with a lot of other stakeholders in this community.

But one of the other impacts that I don't think maybe the Planning Commission can truly address, it's maybe at the city council level, is a comment I heard from someone

in the 10th and Page neighborhood.

And it kind of was even brought more forward to me listing about perhaps a good strategy about tax credits and things that we can offer for hopefully some units that 40% AMI and 60% AMI in the future is that not only would the developer get some type of tax rebate, but when we talk about

Disparate impacts in development.

You also have to look at the surrounding property owners.

And I'm not sure if the houses that are right adjacent to the property are owner occupied or whether they're occupied by people who are renting and are perhaps renting a home that's considered sustainable in our community.

But perhaps if there are some owner occupied units,

that they also be offered some type of tax rebate because with this type of modern development coming to this part of Preston Avenue, there will be, again, more phone calls to those homeowners saying, you want to sell?

You want to sell?

And in fact, in my own neighborhood, I know that one of my neighbors did a study on her

of the property increases and that just the cost of the land itself between 2017 and 2018 doubled.

And that I'm sure has happened or will continue to happen to the property around perhaps the perimeter of that development.

It would be nice if there could be some also quid pro quo.

with homeowners to stay in.

There's a lot of them who probably could be elderly.

Like in my neighborhood, there are still a lot of homeowners that have been there for 30 and 40 years, 25 years, and they're getting into my cohort.

Maybe they're a little older than me, but it would be nice to, even though we don't have a strong impact assessment tool yet,

We do have some impact assessment, but something that doesn't always look at the quality or quantity of life when we talk about development.

My name is Tim Padolino.

I'm a resident homeowner on 9th Street in 10th and Page neighborhood and had the privilege of serving my neighborhood as an appointed official on the 10th and Page Priority Neighborhood Task Force.

So fortunate to have kind of a close look at the neighborhood in that regard.

I want to touch on

A couple things here.

This is obviously a major proposal.

I want to briefly touch on aspects that I find easy to support in fairness to the applicants, and then hopefully have time left over to point out some aspects that are concerning and issues and recommendations I offer for your consideration.

So as far as the affordable housing that's been touched on, I don't want to go into great detail, but the onsite affordable units are obviously worth pointing out, not just putting money into a fund.

Doing this at levels that significantly exceed minimum requirements in terms of 20 units instead of five and 10 years instead of a five-year horizon, and dependent upon the city's ability and the willingness to partner with the applicants, the idea of providing affordable housing at lower AMI levels is really exciting and something that other neighbors of mine do support.

It's really getting into actual true affordability at that point.

In regards to process, there's a lot been said about setting a gold standard, as Commissioner Soll-Yates said.

I think that's – I'll leave it at that.

And as far as the design of this project, there's a lot to be commended.

It seems like a well-considered and well-refined design, at least in Phase 2, and it's a relatively restrained massing in some regards.

And the historic preservation, adaptive reuse, and sustainable design elements are all great.

As far as the project though, it is quite major and there are aspects that I do find concerning.

Some of them are less about the site and the project itself and more about context.

For example, I don't understand how Preston Avenue and the intersections all along that corridor between Washington Park and Ridge McIntyre can possibly handle the vehicle trips.

That would be associated with 261 units.

I travel that every day by car and bike and it's really, at some times,

Low efficiency and at other times downright dangerous.

And then separate from the major framework street of Preston Avenue, the residential streets will also receive a major increase in vehicle trips.

And in a lot of cases, these are on streets that are very narrow.

And for example, on West Street, there's about a 30 degree bend right at the laundromat.

That's a busy place.

There's a lot of people hanging out there.

and if you've got people visiting this neighborhood or trying to find a cut through or circling the block link for a parking space, that's a pinch point that I hope the city can begin to look at in more detail.

Another example is the intersection with 10th Street, excuse me, West Street crossing 10th Street.

There's a significant offset or a jog in that intersection.

It's almost completely offset.

and I think that in and of itself is not a very safe intersection today and if you add in the intensity of development there that's a major concern of mine and I think that's also there's a consideration there with the setback right at that corner on 10th and West it's poor site distances and I just would encourage people to take that into account so as far as recommendations looks like I'm running out of time but I would say that this is a major project and the neighbors and I

I think we've seen a lot of new development popping up in Charlottesville, and the massing and aesthetics of a lot of that development is certainly something that the community has seriously questioned.

when it is very rare to find a developer who will come before this community and actually listen to what the community has to say, speak to them face to face, and then design contextually appropriate projects that directly address what those community comments are.

So when one of these conscientious developers appears before this committee,

It seems to me that you should stand up and take notice.

Because not only are what they're doing important to the community on that project, but as you said before, it sets the gold standard for how developers in the future should behave.

Stonyville design has become one of those rare finds.

They are not only intelligent, they care about the community in which they're building, they listen to the community, they are environmentally conscious,

They have a strong sense of aesthetic design.

They understand and respect the existing landscape and its historical roots.

And they believe in partnerships with the city and with other stakeholders and the community as well.

We are facing an affordable housing crisis in this city.

All you have to do is look around at the number of affordable housing units that have actually been built to understand that this problem is not going to go away any time in the near future.

Standing before you today is a developer who is not only willing to actually build some of these affordable units, but he's willing to build four times the number that the city ordinance requires him to do.

He is also willing to work with the city to try and make it more affordable

to help some of our lower income residents.

On top of that, he's willing to build community event space, he's willing to offer low income rent to non-profit organizations, and he's willing to work with the city's workforce development teams to try and provide jobs to some of the lower income community members.

This city is looking at a whole lot of building being planned in commercial use in the future.

And quite frankly, we don't have the housing options available to house all of the offices that we are building.

So the fact that we have an opportunity to see 200 and some odd additional rental units in the housing area of which many will be affordable is something that we should not lightly pass up.

In addition, this project is offering additional parking, which is very needed near the downtown area.

It is a project that is maintaining the historical facade of the Monticello Dairy Building, showing a respect for maintaining the integrity of the historic nature of an existing building and providing much needed growth in a manner that is not intrusive to the existing fabric of the neighborhood.

My name is John Gaines.

I live on 9th Street, Northwest.

But before I begin, I'd like to commend the developers.

This is a group that all developers need to

take in consideration because they involve the community and they have made an excellent presentation and they have made some concessions which I'm thankful for.

But one question, well there are several questions I have.

One, why does 10th and Page have to bear the blunt

of all rentals in the city of Charlottesville.

We have the highest number of rental units than any neighborhood in Charlottesville.

When Piedmont House did some development in that area, that cut back on rentals.

But presently, we have the highest number of rental units in the city.

A couple concerns I have.

One relates to traffic.

I can't see how this will not have an impact on the narrow streets in the 10th and Page area.

West Street, as the gentleman mentioned, is a very narrow street from 10th to 9th Street.

Anderson Street is very narrow from 10th to 9th Street.

And then Piola is a very narrow street, and 10th Street at the corner of 10th and Page.

But overall, the streets are very narrow.

And this will have a tremendous impact, I would think, on the neighborhoods.

The other relates to parking.

Everybody isn't going to be riding a bike.

And many of these people in the rental units will have more than one vehicle.

So let's go overflow some of the parking if they're entertaining into the neighborhoods.

Those are a couple concerns I have.

It was rewarding to hear though that, and I had a question relating to the schools, that they have contacted the schools as it relates to the units.

I'm going to try not to repeat too much, but I do want to re-emphasize what seems like most everyone's been saying, which is to commend the developer for going out of his way to meet with the neighborhood.

And here are concerns, not only meeting in large groups at a convenient location at a convenient time, something that our site plan process could probably learn from.

but also attending the neighborhood meetings, small group meetings, and seeking out individuals who actually are the more vocal opponents of the project to try and listen to their concerns.

I know there's some members of CADRE, the Charlottesville Area Developers Roundtable here, and I hope that more of them are listening and see that this should set a precedent for how development should happen, how community outreach should happen.

So I get the feeling that my email did get read by some of the questions you guys were asking, so thank you for that.

I understand some of the conditions I wanted maybe aren't legally imposeable.

I do think with amassing a condition that should be added would be the doors that open onto 10th Street and onto the courtyards.

One of the things that makes this project successful is that it opens itself up to the neighborhood as opposed to walling itself off, and that should somehow be memorialized if possible.

I don't know.

Now I'm a little confused as to whether the project is under parked or not, but it sounds like it has less parking than seems desirable, but I just would encourage you guys not to try and increase the parking that's available.

Instead, I would encourage the city to see if there's some way that we could either expand permit parking in the neighborhood or

Preferably preemptively, more cars just mean more cars on our streets.

So if there is some way that they can actually force people to not bring cars, it's going to mitigate the impact of this project.

As far as affordable housing, I mean, this is fantastic.

Obviously, get it memorialized, but I still think we're only chipping away at the problem.

Getting a handful of units per big development that are only affordable for a short term, five, 10 years, that's not solving anything.

As John Gaines was getting at, every neighborhood in the city is going to have to bear the brunt of development.

Or maybe he wasn't saying that, but I'm saying it.

10th and Page, Park Street, Greenbrier, Fry's Spring, they're all going to have to take their share of this.

To be a NIMBY in the city is to desire exclusivity, and exclusivity is not a core value of Charlottesville.

Anyways, building types like this seem to have existed historically in low density residential neighborhoods.

I don't see why this one shouldn't now.

Also, as far as rents, this building isn't going to increase rents.

Rents are already going up.

That's a done deal already.

Property values are already skyrocketing.

If anything, all this is going to do is help meet a little bit of the demand.

Again, just a small portion of the demand.

We need to do a lot more to try and fix that problem.

Yeah, overall, I think this is a great project.

This is what an SUP should be all about.

So let's just hope that we can get some of these conditions in writing.

I first want to start off by saying that I do commend the developers.

I know firsthand they've taken a lot of time to meet in different ways, as the public has said, with the big mass meetings of groups of people.

the neighborhood associations and then also individual stakeholders that live in the community and just would like to reiterate that this should be the model that developers follow from here on out to make sure that our citizens are being heard.

One of my bigger concerns is also traffic and parking.

That neighborhood already has a constraint with traffic and its current parking.

And while I also commend them for almost tripling the affordable units, I have a problem with the short term of those affordable units.

Five to ten years is not going to fix or even begin to fix the issues that we have with affordable units in this city.

The five or ten years, when does that start?

At the beginning of the first CO, or how does that, what is triggered?

Is it when that unit becomes available, so each unit would stagger?

Because some of the things that I've seen is they're there and then they reach out to people and nobody's there for that particular affordability and then it loses its, it has a sunset clause so it can't be rented and then it goes straight to market rate.

I don't know the answer to that question.

Yeah, I mean I think you're, it sounds like you're asking a couple of different questions.

One is when does the affordability period actually start running and the other is if someone offers it to someone on an affordable basis but nobody is located that is willing, you know, or who wants that unit, if they rent it to somebody on a non-affordable basis, does it lose it or

Do you have to go back and offer it to someone on an affordable basis the next time it's available for leasing?

In years past, particularly with for sale units, you often would see proffers that would say the first sale, they would advertise it for a certain period, and then if nobody took them up, they could sell it at a market rate, and then it was done.

But that's not how Ms. Pethea applies the guidelines of the program under the city zoning ordinance.

So you're looking at it from an aesthetic standpoint based on your entrance corridor guidelines.

So the entrance corridor that came to us before, was that just phase two?

It was just phase two.

They brought that forward in part because this being an SUP in an entrance corridor,

I would like to address some homework from the public comment.

Target market rent charge for one and two bedrooms.

I believe right now the market rate for a one bedroom apartment in the city of Charlottesville is somewhere around $1,300 a month.

And for two bedrooms, it's somewhere around $1,600 a month.

Well, we would usually sub-meter all units individually and the tenant would pay for utilities.

Yes, I believe the building materials are primarily brick.

We've talked about using metallic panels for some of the elements that are shown white in your package.

We also have discussed the

Using some stucco, that's actually a relatively common material around Charlottesville and Virginia, but the main building block is brick.

So we don't use EIFS.

It actually raises the cost of our building insurance.

And so stucco would just be the type that's applied to the sheathing.

I just wanted to also say I have the whole 14 page affordable housing policy if anybody wanted

responses on how that works.

I don't know all the pieces of it, but it is very complicated in how the city has tons of requirements on how you pre-advertise all of the affordable units, how you fill them up, the auditing each year of making sure that people who are in those units are still

within that AMI range and what is the grace period if they go outside the range.

So it's a very complicated process, but there is no sunset clause like a proffer.

You have to just keep looking until you fill that unit.

So it's not like those proffers.

If it's listed for three months, then you get to pull it out of the program.

And I think that one of the members of the public, I think it was Tim Padolino, spoke about the site line at 10th and West.

So if I may, we have met with Brennen Duncan and traffic study was scoped, the traffic study was done.

A lot of the things that I think have been brought up were addressed in that traffic study and Brennen was satisfied with it.

A couple of things that have been talked about, originally we did look at that alley that you were just pointing out, Ms. Dowell, with regards to that being a full intersection, but at this point now we have looked at it as only being a right in, right out, not taking

people into the 10th and Page neighborhood.

The other thing that I would say too with regards to some of the geometries and just in general the traffic study was done, the geometries work within and all around the site as well as the max delay that's seen at any of these intersections is eight seconds of additional time.

We still have to get this on paper.

You guys can talk to us and make us promises to the moon.

And we got to get it on paper and memorialize.

So that's where we are right now.

And they would be that phases two and three would have a minimum of 90% residential uses.

Was there any further resolution to the pedestrian crossing concern?

I think as Mr. Gaines has said, this is where a high percentage of our renters are in the city.
